This Data License Agreement ("License") governs your use of real-estate listing data, homeowner contact records, realtor contact records, NCOA-validated mailing addresses, and any related data records (collectively, the "Licensed Data") that you access or receive through the ListingPro product or any related export, API, or delivery mechanism operated by iServices Inc d.b.a. MovingLetters.ai ("MovingLetters"). The License is incorporated into and forms part of the Terms of Service.
1. License grant
Subject to your compliance with this License and the Terms of Service, MovingLetters grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Licensed Data only for your own first-party marketing, lead-generation, and operational activities as a moving-services business inside your contracted service area.
2. Restrictions
You will not, and will not permit any third party to:
- Resell, lease, sublicense, redistribute, syndicate, or otherwise transfer the Licensed Data to any third party;
- Use the Licensed Data to compile, supplement, or update any other database for resale or distribution;
- Use the Licensed Data to train, fine-tune, or evaluate a machine-learning model intended for sale, license, or distribution;
- Combine the Licensed Data with any other data set in a manner that allows reconstruction or republication of the underlying records;
- Publish, post, or otherwise make publicly accessible any individual record from the Licensed Data, including but not limited to phone, email, owner name, or address;
- Use the Licensed Data for any purpose prohibited by law, including unfair, deceptive, or abusive practices, or in violation of TCPA, FCRA, fair-housing law, or RESPA;
- Continue to use the Licensed Data after termination of your account or this License.
3. Ownership
The Licensed Data is owned by MovingLetters and/or its data licensors. No title, ownership, or other rights in or to the Licensed Data are transferred to you under this License. Aggregated, anonymized, and statistical data derived by you in the ordinary course of operating your business is not restricted by this Section provided no individual record is identifiable.
4. Accuracy
The Licensed Data is sourced from MLS feeds, broker portals, public-record databases, NCOA validation services, and licensed enrichment providers. We update on a best-efforts basis. MovingLetters does not warrant that any individual record is current, complete, or accurate, and is not liable for marketing or business decisions made in reliance on any individual record.
5. Termination and post-termination obligations
This License terminates automatically upon termination or expiration of your MovingLetters account, or upon notice from MovingLetters of your material breach. Within thirty (30) days of termination, you will:
- Permanently delete all copies of the Licensed Data from all systems and back-ups under your control;
- Cease all use of the Licensed Data, including any campaigns, sequences, or outreach programs operating against it;
- Upon written request, provide a signed certification of deletion to legal@movingletters.ai.
6. Audit
MovingLetters may, on reasonable notice and no more than once per twelve-month period, request that you describe in writing the systems and processes by which you store, use, and (upon termination) delete the Licensed Data. You agree to cooperate in good faith with a reasonable audit request.
7. Limitation of liability
MovingLetters' liability arising out of or relating to the Licensed Data or this License is limited as described in Section 10 of the Terms of Service. No part of this License creates additional warranties beyond those expressly stated.
